Rules

1. CONTEST AND DURATION 

The “PRINCESS LOUISE – PORT OF QUÉBEC” (hereinafter the “Contest”) is organized by the Québec Port Authority (hereinafter the “Organizer”). The Contest starts on Saturday June 1st at 00:01 a.m., and ends on Monday, September 30, 2024, 23:59 (Eastern Time) (hereinafter “Contest Closing Date”). 

2. ELIGIBILITY 

2.1. The contest is open to anyone aged eighteen (18) and over, residing in the Province of Québec, excluding the employees of the Organizer, the Cale, the Oasis, and the Institut d’incubateur de musique francophone, as well as their administrators, all immediate family members1 and anyone with whom they reside. It is understood that minors are not allowed to take part in the contest. 

1 A group of persons linked by birth, marriage or other relations culturally recognized as constituting immediate family, such as spouses, partners, parents, brothers, sisters, children, adoptive parents and grandparents. 

3. TO PARTICIPATE 

3.1. Participants must answer the five (5) questions comprising the Contest questionnaire that are accessible by scanning the QR code on the LA PRINCESSE LOUISE can. 

Participants are eligible for the Contest by simply completing the answers. 

3.2 A participant may win no more than one prize within a thirty (30) day period. Monthly limit of five (5) entries per person. 

3.3 By entering the Contest, each participant accepts the Contest terms and conditions. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. 

3.4 The Contest is in effect only on the dates shown on the Contest Page dedicated to it. 

4. OWNERSHIP OF ENTRIES 

4.1 All eligible Contest entries must comply with the present terms and conditions. All entries become the property of the Organizer. The Organizer reserves the right to destroy all documents pertaining to the Contest once the retention period required by law has expired. 

4.2 Entries produced by third parties or by a macro or any other automated process (including, but not limited to, a program, tool, service, script, bot, macro, electronic system or program, robotics, or automated contest registration system, commercial or otherwise) or that contain typographical errors, have been altered or falsified, are incomplete or inaccurate, contain irregularities of any kind or that otherwise contravene these rules, will be considered null and void and will render the participant ineligible for the Contest. Any repeated violation of the above provisions by a participant can render him or her ineligible for future promotions or contests of the Organizer. The chances of winning depend on the number of valid entries received by the entry deadline. 

5. DESCRIPTION OF PRIZES 

5.1 MONTHLY PRIZES 

One prize will be awarded each of the four months from June to September 2024, for a total of four prizes. 

  • Two (2) gift cards, each worth $100, valid at Strom Spa Vieux-Québec 
  • Two (2) gift cards, each worth $100, valid at Croisières AML 
  • Two (2) gift cards, each worth $100, valid at Restos Plaisirs restaurants 
  • Two (2) passes, each worth $58, for the TALK show scheduled for September 6, 2024, at the Agora du Port de Québec. 

6. DRAWS 

6.1. Each month’s draw will be held on the first Tuesday of the following month by an employee of the Organizer. The draw for the first prize will therefore be held on Tuesday, July 2, 2024. 

7. PRIZE CONDITIONS 

7.1. The prizes offered must be accepted as is and are not exchangeable, refundable, transferable or convertible to cash. 

7.2. No purchase or entry fee will be required. 

8. CLAIMING PRIZES 

8.1. To be declared winner, the selected participant must comply with the following conditions: 

  • The participant will have to reply to the Organizer within three (3) days following the moment a phone or email message was left for the participant informing him or her of the win. 
  • The prize will be awarded to the winner in person at the Organizer’s offices or will be sent by mail or email, at the winner’s discretion. 

8.2 If the prize winner cannot be reached within three (3) business days after the date of the draw, for whatever reason, he or she will be declared ineligible and deemed to have turned down the prize, with no possibility of replacement, refund, or substitution with any prize of any kind, and under those circumstances, the Organizer can decide at his sole and full discretion, to designate another prize winner based on a draw effected by one of his employees, until a new prize winner can be reached by email or telephone. Should the Organizer decide not to go ahead with a new draw, the prize may simply not be awarded. 

8.3 The Organizer shall not be liable for any failed attempts to reach the winner for any reason, including, but not limited to, if any electronic or telephone communication is unsuccessful, if the prize winner does not respond to such communication, or in the event a notice of non-transmission is received. If all or part of a prize cannot be awarded to the prize winner due to circumstances outside the Organizer’s control, the Organizer may decide, at his sole and full discretion, to attribute a replacement prize or prizes of comparable value. 

9. TERMS AND CONDITIONS 

9.1. Non-compliant participation. The Contest Organizer reserves the right to disqualify a participant or cancel the participation of anyone who participates or tries to participate to this Contest in a manner that does not comply with these rules. The participant may be handed over to the relevant judicial authorities. Any decision by the Organizer relating to the Contest is final and without appeal. 

9.2. Prize replacement or modifications to Contest. The Organizer reserves the right to replace one or several prizes or any element thereof by a prize of similar value or nature or, at their full discretion, by the cash value of the prize indicated in these rules. The Organizer also reserves the right to modify, suspend or end the Contest at any time without prior notice. 

The prize winner may not receive the cash equivalent of the prize or request that it be substituted by some other product or equivalent prize. The prize must be accepted as is and may not be converted into cash in whole or in part. 

No prize may be returned once it has been claimed or delivered, as the case may be. No voucher to claim a prize at a later date will be provided. The prize winner will have no right to any refund or compensation for any expenses incurred. 

In the event that it becomes impossible for the prize sponsor to award the prize (closure, bankruptcy, cancellation of shows or activities, or any other force majeure), the Organizer and their sponsor cannot be held responsible and will not offer a compensatory prize. 

If the prize includes a guarantee, the prize winner recognizes that the manufacturer and/or retailer of the prize provides the only guarantee, where applicable, and the Organizer is entirely released from any liability in this regard. 

9.3. Limitation of liability. The Organizer cannot be held liable for any problem, breakdown, technical malfunction of a network line, online computer system, telephone, peripheral, software, server, provider, email, browser or poor technical functioning that may arise, including but not limited to a problem in the transmission or non-transmission of an entry form, regardless of the cause. The Organizer cannot in any case be held liable for wrongful or inexact information, whether caused by the users or the equipment or programs used for the Contest or by a technical or human error that may have arisen during the Contest, including during the processing of entry forms. Likewise, the Organizer cannot be held liable for any error, omission, interruption, loss, operation or transmission defect, breakdown of communication lines, theft or destruction or prohibited access or changes to the entry forms. 

9.4. Contest functioning. The Contest Organizer makes no guarantee with regard to the uninterrupted functioning or accessibility of the webpages of the Contest or any other related site during the Contest and is exempt of any error in this regard. 

9.5. Contest operation. Any attempt to deliberately damage the Contest or any related site, or to sabotage the legitimate operation of the Contest, constitutes a violation of civil and criminal law. If such attempts are carried out, the Contest Organizer reserves the right to reject the participant’s entries and obtain redress under the law. 

9.6. End of participation in the Contest. In the event that the computer system is unable to record all Contest entries through its duration for any reason whatsoever, notably due to verifications by the platform that holds the Contest, or if participation in the Contest were to end prematurely in whole or in part, the Contest Organizer has the discretion to make the draw from among the entries duly registered during the Contest duration or, if applicable, up until the date of the event causing participation in the Contest to end. 

9.7. Limitation of liability: use of the prize. By participating in this Contest, any winning participant releases from all liability the Contest’s Organizer, any company, trust or other legal entity controlled by or related to them, their advertising or marketing agencies, their employees, agents and representatives (the “beneficiaries”) of any damages they may sustain from accepting or using their prize. 

9.8. Limit of liability: participation in the Contest. Anyone participating or attempting to participate in this Contest releases from all liability the beneficiaries of any damages he or she may sustain from his or her participation or attempt to participate in the Contest. 

9.9. Personal information. This Contest’s participants’ personal information will only be used for administering the Contest. The information is provided to the Organizer. The participant will not receive any communication, advertisement or other that is unrelated to this Contest, unless the participant has consented otherwise. 

9.10. Compliance with the Contest rules. All participants agree to comply with the Contest rules, which are subject to change at the Organizer’s sole discretion. 

9.11. Compliance with applicable laws. The Contest is null and void in any jurisdiction where it is prohibited by law. 

9.12. Divisibility of subclauses. If a competent court declares or deems illegal, unenforceable or void, a subclause of these rules, then the subsection will be considered null and void, but all other unaffected paragraphs will be applied to the full extent of the law.
